Privacy Policy
This Privacy Policy describes how SwingOn (“we,” “us,” or “our”), operated by Albert Lam in San Mateo County, California, collects, uses, shares, and protects your personal information when you use the SwingOn service (the “Service”). By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.
1. Information We Collect
Information you provide directly:
- Name (first and last)
- Email address
- Tennis-related information: stroke type, self-reported skill level, video link, and any optional notes you choose to provide
- Communications you send to us by email or through the form
Payment information:
- Payment is processed by Stripe. SwingOn does NOT receive, view, or store your credit/debit card details or other sensitive payment data. Stripe provides SwingOn only with limited transaction metadata (such as a payment confirmation, payment ID, and the email associated with the payment).
Video content:
- You provide a link to your video, which you host on a third-party service of your choice (e.g., Google Drive). SwingOn views the video for the purpose of providing feedback but does not download or store a copy of the video on SwingOn’s own systems. You are responsible for managing access to your video on the hosting service, including revoking access after you have received your feedback if desired.
Information collected automatically:
- Standard server logs from our hosting provider (Netlify), which may include your IP address, browser type, device type, and pages visited. These logs are used for security and basic operational analytics.
- SwingOn uses or may use analytics tools (such as Google Analytics) to collect basic information about your visit. If analytics are active, a cookie may be set to distinguish unique visitors. SwingOn does not use third-party advertising trackers or remarketing pixels.
2. How We Use Your Information
- To provide the coaching feedback service you paid for
- To communicate with you about your submission (confirmation, delivery, follow-up)
- To process your payment via Stripe
- To maintain records of submissions for service quality, customer support, and legal/tax compliance
- To respond to your inquiries and provide customer support
- To improve the Service over time, including refining our coaching templates and resources (using aggregated or de-identified patterns, not individual identifying details)
We do not sell your personal information. We do not share your information with third parties for those parties’ own marketing purposes.
3. Service Providers and Third Parties
We share information only with service providers that are necessary to operate SwingOn:
- Stripe — payment processing. See Stripe’s Privacy Policy at stripe.com/privacy.
- Tally — form submissions and payment routing. See Tally’s Privacy Policy at tally.so/help/gdpr.
- Netlify — website hosting. See Netlify’s Privacy Policy at netlify.com/privacy.
- Microsoft OneDrive — hosting and delivery of narrated feedback videos we send to you. See Microsoft’s Privacy Policy at privacy.microsoft.com.
- Email service providers (e.g., Gmail) used to communicate with you.
Each provider has its own privacy practices. We do not control how they handle your information beyond our contractual relationship with them. We may also disclose information when required by law, court order, or government request, or to protect the rights, property, or safety of SwingOn, our customers, or others.
4. Data Retention
- Submission data (name, email, stroke, skill level, video link, and the feedback delivered) is retained for twelve (12) months from the date of delivery, for service quality and customer support purposes.
- Payment records are retained for as long as required by applicable tax and accounting laws (typically up to seven years).
- You may request earlier deletion of your information at any time by emailing the contact address below. We will delete your data subject to any legal or tax retention requirements.
5. Video Content Handling
As described above, SwingOn views your video via the link you provide; we do not download or store a copy of your video. The video itself remains under your control on whichever third-party storage service you used (e.g., Google Drive). You are responsible for setting the appropriate sharing permissions on that service and for revoking access once you have received your feedback if you wish to do so.
6. Marketing Use of Your Information
SwingOn will NOT use your video, name, image, or feedback content for marketing, promotional, advertising, or testimonial purposes without your separate, explicit written consent for that specific use.
7. Children’s Privacy
The Service is not intended for users under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we learn that we have inadvertently collected information from someone under 18, we will delete it as soon as we become aware of it. If you believe a minor has provided information to us, please contact us using the email address below.
8. Your California Privacy Rights (CCPA / CPRA)
If you are a California resident, you have the following rights under California law:
- Right to know: You may request information about the categories of personal information we have collected, used, disclosed, or sold (we do not sell), and the specific pieces of personal information we have collected about you.
- Right to delete: You may request that we delete the personal information we have collected from you, subject to certain legal and operational exceptions.
- Right to correct: You may request that we correct inaccurate personal information we hold about you.
- Right to opt out of sale or sharing: SwingOn does not sell personal information and does not share personal information for cross-context behavioral advertising, so there is nothing to opt out of in that respect.
- Right to non-discrimination: You will not receive discriminatory treatment for exercising any of these rights.
To exercise any of these rights, please contact us at the email address below. We may need to verify your identity before fulfilling your request (typically by confirming the email address you used to make a submission and details of that submission).
9. Security
We use reasonable administrative, technical, and physical safeguards to protect the information we collect. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be communicated by updating the Effective Date at the top of this policy and, where appropriate, by direct notification (such as by email to recent customers). Your continued use of the Service after such posting constitutes acceptance of the updated Privacy Policy.
